In Radke, the supreme court allowed a negligence claim against a county and two child protection workers in the investigation of child abuse and neglect reports as required by the Child Abuse Reporting Act (CARA), for failing to protect a nineteen-month old boy who had been visited three times by social workers before being beaten to death. The Radke decision was cited by the Idaho supreme court addressing a similar issue and received local and national attention. The case has been discussed in The Minnesota Lawyer, The William Mitchell Law Review, The Rutgers Law Journal, The Washburn Law Journal, the Association of American Trial Lawyers Law Reporter, and other publications.
