I have been successfully representing clients as a Minnesota civil litigation attorney in state and federal district courts and appellate courts since 1983. I have briefed, argued, and won reversals at the Minnesota Supreme Court, the Minnesota Court of Appeals, and the United States Court of Appeals for the Eighth Circuit. 

My cases have been covered by news outlets. The favorable Minnesota supreme court decision obtained in Larson v. Gannett Company, Inc., was named as one of the top 20 cases decided by the state and federal appellate courts in 2020 in The Minnesota Lawyer.   • Larson v. Gannett Co. Inc., 940 N.W. 2d 120 (Minn. 2020), Rehearing denied. Obtained order for new trial by supreme court in media defamation case reversing Court of Appeals and jury verdict
  • Stewart v. Rise, Inc., 791 F. 3d 849 (8th Cir. 2015) Obtained reversal of summary judgment on hostile environment/harassment claim for first reported case of race and sexual harassment of a supervisor by subordinates 
  • In Re: Guardianship of Jeraldine J. Pates, 823 N.W. 2d 881 (Minn. App. 2012). Case established rule interpreting protective powers under guardianship and conservatorship statutes and requirement of bond in conservatorships
  • Stockton v. Northwest Airlines, Inc., 804 F.Supp. 2d 938 (D. Minn. 2011): Summary judgment denied in disability discrimination case by discharged employee
  • Lake v. Yellow Transportation, Inc., 596 F. 3d 871 (8th Cir. 2010): Obtained reversal by 8th Circuit Court of Appeals of summary judgment in race discrimination case
  • Radke v. County of Freeborn, 694 N.W. 2d 788 (Minn. 2005): Supreme court created cause of action for wrongful death negligence in investigation of child abuse by county social workers. Obtained settlement and $150,000 judgment
  • Patterson v. Wu Family Corp., 608 N.W. 2d 863 (Minn. 2000): Supreme court established rule for waiver of service of process defense permitting lawsuit to proceed
  • Barton v. Moore, 558 N.W. 2d 746 (Minn. 1997): Sued individuals and pierced corporate veil in case in which supreme court established that usurious loans are not void
  • Onwuka v. Federal Express Corp., 178 F.R.D. 508 (D. Minn. 1997): Obtained prominent federal court ruling allowing plaintiff-employee discovery of internal investigation in race discrimination case over work product objection

  • Lake v. Yellow Transportation, Inc., 596 F. 3d 871 (8th Cir. 2010): Obtained reversal by the U.S. Eighth Circuit Court of Appeals of summary judgment in a wrongful discharge race discrimination case in federal court
Wrongful Death.  I succesfully represented the father of a 19-month old toddler who was beaten to death by the boyfriend of his estranged mother in the precedent-setting case of Radke v. County of Freeborn, 694 N.W. 2d 788 (Minn. 2005). In Radke, the Minnesota supreme court allowed a negligence claim against a county and two child protection social workers in the investigation of child abuse and neglect reports as required by the Child Abuse Reporting Act (CARA), for failing to protect a nineteen-month old boy who had been visited three times by social workers before being beaten to death.  I obtained a monetary settlement and $150,000 judgment.
